Debt rehabilitation is one of the most misunderstood terms in South African personal finance. It is not the same as debt review and it is not the same as credit repair. Here is exactly what debt rehabilitation means, how it works, and who qualifies.
What is debt rehabilitation?
In South Africa, debt rehabilitation is the formal legal process, usually under the Insolvency Act, by which a person who has been sequestrated (declared insolvent) is restored to a normal financial standing. Once rehabilitated, the person regains full contractual capacity and the insolvency listing is removed from their credit record.
Difference between debt rehabilitation and debt review removal
Debt review removal applies if you were placed under debt review (debt counselling) under the National Credit Act. Exiting debt review is a different process to rehabilitation.
Debt rehabilitation applies if you were formally sequestrated by a court. The rehabilitation process restores your insolvent estate and removes the insolvency record.
Who qualifies for formal rehabilitation?
You generally qualify if:
- 10 years have passed since your sequestration (automatic rehabilitation)
- 4 years have passed and your trustee has filed a final account
- Sufficient assets were recovered to satisfy creditors
- Your composition with creditors was accepted
Earlier rehabilitation is possible in certain circumstances with court approval.
